PRIVACY POLICY

FuseHive Interactive Media Ltd. privacy policy tells you what information we collect at our web sites and how we use it. If you choose to visit any of the FuseHive Interactive Media Ltd. web sites, your visit is subject to this privacy policy, and you agree to the terms of it.  



WHAT INFORMATION WE COLLECT 

There are many places at our sites where you can share your personal information with us, and where you can communicate with others. 

Registration. Some of our sites give you the opportunity to register with us, and sometimes registration is required before certain site features can be used. Our registration forms may request your contact information (such as your name, email address, mailing address, etc.), demographic information (such as your country, gender, etc.), and profile data (such as your music preferences, entertainment practices, etc). You may be assigned a site username and/or password. For our internal purposes, we use this information to communicate with you and provide the services you have requested, and to provide a more personalized experience on our sites. For example, your registration may allow you to use and post to site message boards, create site profiles, etc. We use aggregate demographic and profile information about our audience in order to improve our service, for research purposes, marketing/promotional purposes and/or for industry reporting purposes, among others. By visiting our sites, you affirmatively consent to our collection and use of your data.  

Newsletters and Other Communications from Us. Our registered users and customers may receive newsletters, email communications, or communications through other channels for, among other purposes, the promotion and marketing of a product or service from our family of sites and record labels, as well as other companies, and business partners, and we may also offer other visitors to our sites the opportunity to sign up to receive such information. When there is a separate sign-up for newsletters, we ask for contact information such as name and email address, and, sometimes, demographic and profile information. By visiting our sites, you affirmatively consent to our collection and use of your data. We use this information in the same manner as we use the contact information in the Registration process described above. We may offer our users the choice whether to receive mailings from others that we think will be of interest. Recipients of our mailings can unsubscribe by following instructions that may appear at the end of email communications. Note that in order to keep our registered users informed about the operation of our services, we may send emails and announcements that are needed for the proper functioning and administration of our sites and service. 

Communications with Us. We have features where you can submit information to us (such as when contacting us with a question or feedback). We may retain your emails and other information you submit to us for our internal purposes, and to help us to serve you better.  

Communications with Friends. We may offer features where you can send information to others, such as e-cards or "Tell A Friend" features. We will use the contact information you enter for your friends to send the email or e-card. 

Interactive and Community Features. Our sites may offer interactive and community features, such as message boards, chat, email accounts, short message service (SMS), instant messaging, profiles, personal homepages, etc. All information posted or sent through these features may be publicly available, and you should be aware that when you voluntarily disclose personal information (e.g., user name, email address, phone number) through these features, that information can be collected and used by others and may result in unsolicited communications from other people. By accessing these features and disclosing personal information, you affirmatively consent to the distribution of your personal information as described above. Users' posts may be publicly and/or internally associated with their profiles/screen-names. Users are solely responsible for the content of messages they post or send on public forums. 

Contests, Sweepstakes and Surveys. We may also have contests, sweepstakes and surveys at our sites. When you enter or participate in them, we request contact information from you (such as your full name, email address, mailing address, and telephone number) and may also request demographic or profile information. We will use the information you provide for the purpose of conducting the promotion (for example, to contact you if you have won). We may also use the information to send you newsletters and other information we think may be of interest. Recipients of our mailings can unsubscribe by following instructions that may appear at the end of the email communication. Any personal information we collect may be associated with registration information. We may share aggregate information with others. We may sometimes partner with sponsors in offering contests, sweepstakes or surveys, and may share (provide and receive) information with them. By entering or participating in such contests, sweepstakes, and surveys, you affirmatively consent to our collection and use of your data.  



AUTOMATIC DATA COLLECTION 

Our web sites have features that automatically collect information from users to assist us in creating sites that honor our users' preferences and serve their interests and needs.  
Some of our sites use cookies, which are small data files containing information about the user that are stored on the user's hard drive. Some cookies are used to make login to our sites easier (such as by remembering usernames and passwords). Cookies can also enable us to track users' movements and target their interests to enhance their experience at our sites. We may also collect clickstream data and assign unique identifiers to our users for the same purposes. Information obtained with these technologies may be associated with your personal information so we can better market to you and customise our advertisements and promotions to your interests.  
 We may use third-party advertising companies to serve ads when you visit our web sites.  These companies may use information (not including your name, address, email address or telephone number) about your visits to our sites and other web sites on the Internet in order to provide advertisements about goods and services of interest to you.  If you would like to learn more about this practice or find out how you can opt out from allowing these companies to gather this information or use it to display targeted ads. 
Most common web browsers today, such as Firefox, Safari and Internet Explorer, allow you to modify your settings to block cookies entirely, alert you every time they are being sent, or allow their use by only those web sites you choose.  You can also delete cookies that are currently stored on your computer’s hard drive.  To do this within Firefox or Internet Explorer, go to Tools, then Options or Internet Options, and then choose the Privacy tab to make your selections.  If you choose to disable cookies, certain features on our web sites may not be available or work properly.  Also, please note that if you disable/delete all cookies stored on your computer, you will have also disabled the cookies that are used by NAI to help prevent you from receiving unwanted advertising from third party ad networks.  If you do not want this to happen, please make sure not to disable/delete the NAI cookie or add NAI to the approved list of sites from whom you allow/accept cookies. 
Through the use of web logs or log files, we may also gather information such as the date, time, browser type, navigation history, and IP address of all visitors to our site(s). We use this information for our internal security audit log, trend analysis, and system administration, and to gather broad demographic information about our user base. We may associate this information with your personal information. By visiting our sites, you affirmatively consent to our collection, use, and distribution of your data.  



WITH WHOM YOUR INFORMATION IS SHARED 

Information provided at Artist sites that we host or manage may be shared with that Artist, including their management, representatives, and any new label they may join. As with other third parties, we are not responsible for how the Artists handle the data once they receive it. When we have co-branded or sponsored services, when we host a site, or when we join with other parties to provide specific services, we may share (provide and receive) your personal information with them. By visiting these sites, you affirmatively consent to our collection, use and distribution of your data.  
We may share your information with other third parties with whom we have business relationships and, in some cases, we cannot control or know their privacy practices. By visiting our sites, you affirmatively consent to our collection, use, and distribution of your data.  
Other than as set forth in this policy, we do not share your personally identifiable information with other companies, apart from those acting as our agents in providing our service to you, and which agree to use it only for that purpose and to keep the information secure and confidential. Also, please be aware that our parent company, including all its business units, subsidiaries, affiliates and sites, FuseHive Interactive Media Ltd. subsidiary and affiliated companies and sites, entities into which our companies may be merged, or entities to which any of our assets, products, sites or operations may be transferred, may obtain from us and be able to use your personal information. We will also disclose information we maintain when required to do so by law, for example, in response to a court order or a subpoena or other legal obligation, in response to a law enforcement agency's request, or in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property. You should also be aware that courts of Australia, may have the authority under certain circumstances to permit your information to be shared or transferred to third parties without your permission.  
We may share (provide and receive) aggregate information, which is not personally identifiable, with others. This information may include demographic data such as the gender and/or geographic location of groups of users, but it will not include personal information (such as your name or email address). We use aggregate demographic information about our audience in order to improve our service, for research purposes, marketing/promotional purposes and/or for industry reporting purposes, among others. 



CHOICE  

By accepting this privacy policy, you expressly choose to receive certain communications from us and third parties, and you expressly agree to the privacy practices described herein. Our sites may also provide you with additional specific opportunities to select communications you wish to receive. You may change your privacy preferences, e.g. choose to cease receiving certain communications, by informing us of your new preferences. We will be able to honor your new preferences most quickly if you inform us of them by following the appropriate instructions in any communication you receive from us. Please be aware that messages you receive from us through SMS and instant messaging systems (and other systems apart from email) may not include an option to cease receiving communications; to change your privacy preferences with respect to those communications, please go to the profile page at the site where you provided your personal information or direct your instructions to the Contact identified at the end of this policy.  



ACCESS  

If a user's personally identifiable information changes (such as zip code), we endeavor to provide a way to correct or update that user's personal data. Please feel free to contact us if you have any questions regarding making changes to your data.  



DATA COLLECTION FROM CHILDREN 

We strive to comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from AUS. children under 13 without appropriate parental notice and consent. Sites that are directed to children where personal information is collected should have a Children's Privacy Policy setting forth our COPPA-compliant practices. At many sites, we actively screen-out children from data collection and/or use of interactive or community features. We are committed to protecting children's privacy.  



SECURITY 

Security for all personally identifiable information is extremely important to us. We store your personal information securely, and use special procedures designed to protect the information we collect from loss, misuse, unauthorized access or disclosure, alteration or destruction.  



MERCHANT/E-COMMERCE AREAS 

We do not generally make e-commerce offerings at our sites. Some of our sites do have merchant/e-commerce areas, where users can purchase merchandise. FuseHive Interactive Media Ltd. does not run those areas of our sites. Personal information collected at those areas is not shared with FuseHive Interactive Media Ltd. without the purchasers' consent. At each of those areas, we endeavour to provide a privacy policy link where users can review the privacy policies that apply to data collection and use at those areas, and we urge our users to review them. Please be aware that the site at iClassics.com is an exception, where we do make e-commerce offerings, and it is covered by a separate privacy policy. Please review it if you use that site. 



LINKS  

We may provide links to non FuseHive Interactive Media Ltd. sites. We are not responsible for those other sites, their privacy policies or how they treat information about their users, and we advise you to check their privacy policies.  



PRIVACY POLICY CHANGES 

We reserve the right to modify, alter or otherwise update this Privacy Policy at any time, so we encourage you to review this policy from time to time. Changes to this privacy policy are effective at the time they are posted and your continued use of our sites after posting will constitute acceptance of, and agreement to be bound by, those changes.

These terms of use (the “Terms”) govern your access to and use of “FuseHive Interactive Media” websites and mobile applications (“Site”). By accessing or using the Site, you are agreeing to these Terms and entering into a legally binding contract with “FuseHive Interactive Media Ltd” (“FH”). It is important that you read carefully and understand the Terms.  Do not access or use the Site if you are unwilling or unable to be bound by the Terms.  
Any references to “you” and “your” refer to you, as a user of the Site. References to “we”, “us” and “our” refer to “FuseHive Interactive Media Ltd”.  



1.  CHANGES TO THE TERMS AND CONDITIONS  

We may modify the “Terms” from time to time. When changes are made, we will notify you by making the revised version available on this webpage, and will indicate at the top of this page the date that revisions were last made. All material modifications will apply prospectively only. You should revisit these “Terms” on a regular basis, as revised versions will be binding on you. Any such modification will be effective upon our posting of new “Terms”. 2. USING THE SITE  

A. Permission to Use the Site: We grant you permission to use the Site subject to the restrictions in these “Terms”. We may terminate your permission to use the Site for any conduct that we consider to be inappropriate, or for your breach of these “Terms”, including the Restrictions listed in paragraph 4. C. User Accounts: If however some stage FH may require you to register to use part of the Site. We may reject or require that you change any user name, password or other information that you provide to us in registering. Your user name and password are for your personal use only and should be kept confidential; you are responsible for any use of your user name and password, and you agree to promptly notify us of any confidentiality breach or unauthorized use of your user name and password, or your Site account. We reserve the right to close your account at any time, at our sole discretion, for any reason whatsoever. Furthermore, we reserve the right to reveal your identity (including whatever information we know about you) in the event of a complaint or legal action arising from any message posted by you or when necessary to protect safety and security.

A. Responsibility for Your Content: You alone are responsible for the content of your messages, and you agree to indemnify and hold harmless FH and our agents with respect to any claim based upon the transmission of your message(s) and/or posting(s). We reserve the right to remove any messages for any or no reason whatsoever.   

B. FH’s Right to Use Your Content: By posting messages, uploading files, inputting data, or engaging in any other form of communication through this Site, you are granting FH a royalty-free, perpetual, non-exclusive, unrestricted, fully transferable, worldwide license to: (1) use, copy, sublicense, adapt, transmit, publicly perform, or display any such communication; and (2) sublicense to third parties the unrestricted right to exercise any of the foregoing rights granted with respect to the communication. The foregoing rights shall include the right to exploit any proprietary rights in such communication, including but not limited to rights under copyright, trademark, service mark or patent laws under any relevant jurisdiction.  

C. Ownership: All material on the Site, including, but not limited to, text, data, graphics, logos, button icons, images, audio clips, video clips, links, digital downloads, data compilations, and software is owned, controlled by, or licensed to FH and is protected by copyright, trademark, or / and other intellectual property rights. Material on the Site is made available solely for your personal, non-commercial use and may not be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, including by e-mail or other electronic means, without the express prior written consent of FH in each instance. You may download material intentionally made available for downloading from the Site for your personal, non-commercial use only, provided that you keep intact any and all copyright and other proprietary notices that may appear on such materials.  



4. RESTRICTIONS 

The following rules, policies, and disclaimers shall apply to and/or govern your use of the Site (including, without limitation, any bulletin boards, chat rooms, or other online services provided on this Site).  We do not review every message or confirm the accuracy or validity of information posted. We do not actively monitor the contents of the postings and are not responsible for the content of any postings. We do not vouch for or warrant the validity, accuracy, completeness, or usefulness of any message or information posted. The contents of the postings do not represent the views of FH, its labels, or any person or entity associated with FH. If you feel that any posting is objectionable, we encourage you to contact us by email. We will make every effort to remove objectionable content if we deem removal to be warranted. Please understand that removal or editing of any posting is a manual process and might not occur immediately.  

A. You agree not to, and will not assist, encourage, or enable others to use the Site to:  
i. Post any material that is knowingly false and/or defamatory, inaccurate, abusive, vulgar, obscene, profane, hateful, harassing, sexually oriented, threatening, invasive of anyone’s privacy, or otherwise in violation of any law; 
ii. Post or transmit any material in violation of a third party’s copyright or other intellectual property or proprietary rights; 
iii. Post or transmit any information or software that contains a virus, worm, defects, Trojan horses or other items of a harmful, disruptive or deleterious nature; 
iv. Engage in commercial activity (including, but not limited to, sales, contests or sweepstakes) without FH prior written consent;  
v. Solicit, request or collect personal information for commercial or unlawful purposes; 
vi. Solicit personal information from minors; 
vii. Send bulk emails, surveys, or other mass messaging whether commercial in nature or not;  
viii. Engage in keyword spamming, or otherwise attempt to manipulate the Site’s search results; or 
ix. Impersonate any other individual or entity. 

B. You also agree not to, and will not assist, encourage, or enable others to:  
i. Restrict or inhibit any other user from using and enjoying the Site (for examples, by means of hacking or defacement); 
ii. Utilize any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape or index any portion of the Site; 
iii. Remove or modify any copyright, trademark or other proprietary rights notice that appears on any portion of the Site or on any materials printed or copied from the Site; 
iv. Record, process or mine information about other users; 
v. Reformat or frame any portion of the Site; 
vi. Take any action that imposes, or may impose, in our sole discretion, an unreasonable or disproportionately large load on FH technology infrastructure or otherwise make excessive traffic demands of the Site;  
vii. Attempt to gain unauthorized access to the Site, user accounts, computer systems or networks connected to the Site through hacking, password mining or any other means; 
viii. Use any device, software or routine that interferes with the proper working of the Site, or otherwise attempt to interfere with the proper working of the Site; 
ix. Use the Site to violate the security of any computer network, crack passwords or security encryption codes; disrupt or interfere with the security of, or otherwise cause harm to, the Site; or

5. UNSOLICITED SUBMISSIONS 

FH and its employees do not accept or consider unsolicited sound recordings, musical compositions or any other creative materials (collectively, the “Submission”). If, despite our policy, you still have submitted unsolicited material to us then FH will not be obligated to treat your Submission as confidential or proprietary and, by making such a Submission, you will be deemed to have acknowledged that i) FH has no obligation and shall not be liable to you or to any person claiming through you based on such Submission and ii) you relinquish any claim whatsoever based upon your submission. 



6. PRIVACY POLICY 

Use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.  



7. THIRD PARTIES 

The Site may include links to other websites or applications (each, a “Third Party Site”). Unless otherwise noted, FH does not operate, control or endorse any information, products, or services on any Third Party Site. You agree that we are not responsible for the availability or contents of any Third Party Sites and that your use of any Third Party Site is at your own risk. 



8. INDEMNIFICATION 

You agree to indemnify, defend and hold harmless FH and its affiliated companies, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including but not limited to reasonable attorneys’ fees, resulting from (i) your access to or use of the Site, (ii) your violation of the Terms, (iii) your use of any products or services purchased or obtained by you in connection with the Site, or (iv) the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity. FH reserves the right, at your expense, to assume the exclusive defence and control of any matter subject to indemnification by you.  



9. WARRANTY DISCLAIMER AND LIMITATIONS OF LIABILITY 

PLEASE READ THIS SECTION CAREFULLY SINCE IT LIMITS THE LIABILITY OF FH AND ITS SUBSIDIARIES, AFFILIATES, AND LICENSORS. EACH OF THESE SUBSECTIONS BELOW ONLY APPLIES UP TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW. NOTHING HEREIN IS INTENDED TO LIMIT ANY RIGHTS YOU MAY HAVE WHICH MAY NOT BE LAWFULLY LIMITED. 
A. THE SITE IS MADE AVAILABLE TO YOU ON AN “AS IS”, “WITH ALL FAULTS” AND “AS AVAILABLE” BASIS. YOUR USE OF THE SITE IS AT YOUR OWN DISCRETION AND RISK. FH MAKES NO CLAIMS OR PROMISES ABOUT THE QUALITY, ACCURACY, OR RELIABILITY OF THE SITE, ITS SAFETY OR SECURITY, OR THE SITE CONTENT. E. FH DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE MATERIALS ON THE SITE OR ANY THIRD PARTY SITE. 
F. FH MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING HOW OFTEN THE MATERIALS OR INFORMATION POSTED ON THE SITE WILL BE UPDATED (IF AT ALL) OR THE NUMBER OR IDENTIFICATION OF THE RECORDING ARTISTS OR OTHER INDIVIDUALS (IF ANY) THAT WILL BE FEATURED ON THE SITE. 



10. VOID WHERE PROHIBITED 

Although this Site is accessible worldwide, not all products or services discussed or referenced on this Site are available to all persons or in all geographic locations. FH reserves the right to limit, in its sole discretion, the provision and quantity of any product or service to any person or geographic area it so desires. Any offer for any product or service made in this Site is void where prohibited.   



11. MAKING PURCHASES 

If you wish to purchase products or services described on the Site, you may be asked to supply certain information including credit card or other payment information. By initiating a transaction you warrant and represent that you (A) are eighteen (18) years of age or older and (B) have the legal right to use the payment means you select. You agree that all information that you provide will be accurate, complete and current. You agree to pay all charges, including shipping and handling charges, incurred by users of your credit card or other payment mechanism at the prices in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to your purchases. FH will be entitled to change the pricing and availability of any particular product(s) or service(s) without prior notice at any time. FH does not offer refunds in the event of temporary or permanent price drops following purchase at higher prices. All sales of digital content are final.   



12. RULES FOR PROMOTIONS 

Any contests, sweepstakes, surveys, games or similar promotions (collectively “Promotions“) made available through the Site may be governed by specific rules that are separate from these Terms. By participating in any such Promotions, you will become subject to those rules, which may vary from the Terms set forth herein. FH advises you to review carefully any specific rules applicable to a particular Promotion and to review our Privacy Policy, which, in addition to these Terms, governs any information, you submit in connection with such activities. To the extent that the rules for a Promotion conflict with these Terms, the Promotion rules shall control.  



13. CHOICE OF LAW AND VENUE 

These Terms shall be governed by, and construed in accordance with, the laws of Australia, exclusive of its choice of law rules. Each party submits to the exclusive jurisdiction of the state and federal courts sitting in Sydney , Australia, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. Each party further agrees as follows: (i) any claim brought to enforce these Terms must be commenced within two (2) years of the cause of action accruing; (ii) no recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys' fees; and (iii) any claim must be brought individually and not consolidated as part of a group or class action complaint. 



14. GENERAL TERMS 

A. In the event that any of the provisions of the Terms are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect.  
B. The Terms contain the entire agreement between you and us regarding the use of the Site, and supersede any prior agreement between you and us on such subject matter. The parties acknowledge that no reliance is placed on any representation made but not expressly contained in these Terms. 
C. We may provide you with notices, including those regarding changes to the Terms by email, regular mail or communications through the Site. 
D. Any failure by FH to exercise or enforce any right or provision of the Terms does not constitute a waiver of such right or provision. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. 
E. The Terms are not assignable, transferable or sub-licensable by you except with FH prior written consent, but may be assigned or transferred by us without restriction. Any assignment attempted to be made in violation of the Terms shall be void. 
F. The section titles in the Terms are for convenience only and have no legal or contractual effect.   



15. DESIGNATED AGENT UNDER THE COPYRIGHT ACT
